Recently, a senior military officer defended by attorney Richard
V. Stevens (Military Defense Law Offices of Richard V. Stevens, P.C.) who had
previously been cleared of the sexual assault allegations he faced (UCMJ Article
120) retired honorably from the military, at the highest rank he held.
The officer client was accused of sexual assault, and the government
investigation that followed presumed his guilt and did virtually nothing to
expose the credibility issues and motives of his accuser. The defense investigation and case
preparation uncovered multiple credibility and motive issues, including other provably
false allegations made by the accuser.
After the case was litigated, and the officer client was cleared, he
continued his military career until his recent retirement. Because the litigation of his case exonerated
him, there was no reasonable basis for an Officer Grade Determination (OGD),
and he retired at the highest rank he held.
He now moves on to the next chapter in his life, unencumbered by
the possible ramifications that can follow the allegations he faced. While the defense was successful in this
case, it is important to understand that every case has different facts, and
success in some previous case(s) does not guarantee success in any particular
future case. No military lawyer or
